Trade Secrets
Under the laws of the State of Oklahoma [78 O.S. ยง 86(4)], a trade secret means information, including a formula, pattern, compilation, program, device, method, technique or process that:
- derives independent economic value from not being generally known to or readily ascertainable by other persons who can obtain economic value from its disclosure or use; and
- is the subject of efforts that are reasonable under the circumstances to maintain its secrecy.
The law also specifies that the crime of theft or improper disclosure of trade secrets does not require the existence of a contract or agreement prohibiting such actions.
