Toby McKinstry is an experienced trial lawyer in a broad range of civil litigation, including contract and business disputes, employment disputes, medical malpractice, personal injury, products liability, oil- and gas-related cases, insurance defense, and franchise disputes. He represents both plaintiffs and defendants before state and federal courts and has extensive experience in early dispute resolution through mediation and arbitration.

Toby has advised business clients in a wide variety of fields including insurance, manufacturing, oil field services, gas gathering, and he has represented numerous individuals, families and companies as plaintiffs and defendants in personal injury and wrongful death cases. Toby believes in delivering active, efficient representation for his clients, and works to ensure responsiveness to every client, and that each case is continually pushed to conclusion.

  • Represents several oil and gas exploration companies in matters concerning disputes with landowners over rights-of-way and surface damages
  • Actively represents several oil and gas companies and oilfield service companies as defense counsel in claims involving contract disputes, pollution, downhole failures and personal injuries
  • Represents one of the nation's largest gas gathering companies as counsel concerning legislative and other business issues
  • Represented numerous insurance carriers in bad faith lawsuits involving automobile, homeowner and health insurance policies, including several cases with national implications
  • Represented numerous individuals and families as plaintiff for victims of serious injuries or death as the result of automobile collisions and other events, including a $750,000 jury verdict in a wrongful death case
